Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Airlock desktop application, cloud services, website, and related software (collectively, the "Service") provided by Airlock ("Airlock," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. The Service

3.1 Description

Airlock provides AI-powered real-time safety, privacy, and incident response tools for livestreams. The Service includes a desktop application that runs locally on your device, cloud-based account management and licensing services, and a website.

3.2 Local Processing

The Airlock desktop application processes audio and video data entirely on your local device. Your media streams are not transmitted to Airlock servers. You are solely responsible for the content of your streams and the configuration of your protection policies.

3.3 Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. The local desktop application will continue to function independently of cloud service availability for core protection features.

4. Subscriptions and Payments

4.1 Plans

The Service is offered under subscription plans as described on our pricing page. Features and limitations vary by plan. We reserve the right to modify plan features and pricing with reasonable notice.

4.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on each billing cycle.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods unless required by applicable law.

We may offer free tiers, trials, or early access programs at our discretion. These may be subject to additional terms and may be modified or discontinued at any time.

6.1 Our Rights

The Service, including all software, designs, documentation, and content, is owned by Airlock and protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

6.2 Your Content

You retain all rights to your audio, video, and other content processed by the Service. Since Airlock processes your content locally on your device, we do not claim any ownership or license over your content.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback into the Service without obligation to you.

7. Third-Party Integrations

The Service may integrate with third-party software and services, including OBS Studio, streaming platforms, and payment processors. Your use of third-party services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Disclaimers

8.1 No Guarantee of Detection

Airlock uses AI-based detection and analysis, which is inherently probabilistic. We do not guarantee that the Service will detect all risks, prevent all incidents, or eliminate all harmful content from your streams. The Service is a supplementary protection tool and does not replace human judgment, moderation, or legal compliance obligations.

8.2 As-Is Basis

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRLOCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, REPUTATION, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Airlock and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will survive.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

13. General Provisions

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

13.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Airlock regarding the Service and supersede all prior agreements.

13.5 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

13.6 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
